The exact date of his death is unknown. He did not appear on the 1860 census. A sale in connection with his estate was held on 18 February 1861. During the War Between the States, Federal troops burned the Giles County courthouse. The final settlement of the estate was made on 06 April 1866, and the details had to be recalled from memory by the Circuit Court Clerk. During the War, the clerk had made distributions to the heirs, paying them with Confederate money which was of course worthless after the war. He was ordered by the 1866 Court to make a second distribution in US dollars. He appealed the case to the Supreme Court.
